Agility Fellows Scholarship Program — v3.7, June 2026

Terms and Conditions

The Agility Fellows Scholarship Program has been voluntarily established by Agility to provide financial assistance to academically capable dependent children of eligible Agility employees who demonstrate financial need and wish to attend university. Agility will administer the Program in good faith and will take reasonable steps to assess applicants consistently and fairly throughout the application, eligibility verification, assessment, selection, notification, award and scholarship-administration processes.

Participation in the Program is entirely voluntary. However, applicants who choose to participate must provide the information reasonably required to assess and administer their application and must comply with these Terms and Conditions.

Submission of an application does not guarantee that an applicant will receive a scholarship. Scholarships are competitively awarded at Agility’s discretion, subject to available funding, published eligibility requirements and Applicable Law.

By submitting an application, the applicant agrees to the following: 

  • 1. Submission of an application does not guarantee selection as a scholarship recipient.
  • 2. Scholarships are competitively awarded at Agility’s discretion, subject to available funding, the Program requirements and Applicable Law.
  • 3. The Program, these Terms and Conditions and any scholarship award agreement shall be governed by the laws of the Abu Dhabi Global Market (hereinafter referred to as “ADGM” or “Applicable Law”) and disputes relating to the Program or a scholarship award shall be subject to the exclusive jurisdiction of the ADGM Courts.
  • 4. Applicants and awardees must comply with the reasonable rules, requirements and instructions communicated by Agility in connection with the Program.
  • 5. Agility is responsible for decisions concerning scholarship eligibility, assessment, selection, rejection, award, continuation, revocation and permitted use of scholarship funds.
  • 6. Agility may determine whether an applicant satisfies the Program’s eligibility and assessment criteria and may verify information submitted in support of an application.
  • 7. Scholarship decisions are final and are not ordinarily subject to reconsideration or appeal.
  • 8. Nothing in these Terms and Conditions excludes or restricts any right or remedy that cannot lawfully be excluded or restricted.
  • 9. Where a concern or dispute arises, applicants should first make reasonable efforts to resolve it through direct discussion with Agility’s designated Program managers. This does not prevent an applicant from exercising any applicable legal or regulatory right.
  • 10. Applicants must electronically sign or otherwise electronically confirm their acceptance of these Terms and Conditions before submitting an application.
  • 11. Agility may contact schools, universities, employers, references, community organizations, clubs, teams or other persons or organizations identified in the application where reasonably necessary to:
    • a. Confirm information provided by the applicant;
    • b. Verify eligibility; 
    • c. Assess academic achievement, financial need or other published criteria; or 
    • d. Investigate suspected fraud or material misrepresentation. 
  • 12. Applicants must read the Scholarship Program Privacy Notice set out below. Acceptance of these Terms and Conditions constitutes acknowledgement of the Privacy Notice but does not constitute consent where Agility relies on another lawful basis for processing personal data.
  • 13. Before submitting an application and/or participating in any program-related activities and/or processes I agree to abide by all Agility terms, conditions and requirements of the Fellowship Scholarship program.
  • 14. Agility is the final authority for all decisions related to any scholarship matter.
  • 15. Each applicant must certify that the information provided is, to the best of their knowledge, complete, accurate and not misleading. Where an applicant or awardee deliberately or recklessly provides materially false or misleading information, Agility may reject the application, revoke an award or seek repayment of funds, subject to Applicable Law.
  • 16. All decisions taken by Agility and its team members or assigns related to the scholarship application, screening, assessment, selection or rejection, award and any related funding, or any other matter related to the Fellows Scholarship and my participation in it, are final and may not be contested under any conditions for any reason.
  • 17. Acknowledge that:
    • a. The scholarship is competitively awarded;
    • b. Participation in the application and assessment process is voluntary;
    • c. The provision of certain information is necessary for Agility to assess and administer an application; and
    • d. Submission of an application does not create an entitlement to scholarship funding.
  • 18. Applicants aged 18 or older must confirm that they have read and understood these Terms and Conditions and the Scholarship Program Privacy Notice.
  • 19. Where an applicant is under 18:
    • a. The applicant’s Agility-employee parent or another person with parental responsibility must authorise the applicant’s participation;
    • b. The parent or guardian must confirm that they have read and understood these Terms and Conditions and the Scholarship Program Privacy Notice;
    • c. Information must also be provided to the child by the parent or guardian [A L5.1]in clear and age-appropriate language; and
    • d. Agility may seek the child’s agreement or involvement where appropriate, taking account of the child’s age, maturity and Applicable Law.
  • 20. Agility reserves the right to amend, suspend or discontinue the Program where reasonably necessary, including because of changes to funding, operational requirements, legal obligations or circumstances outside Agility’s reasonable control. Where practicable, Agility will provide reasonable notice of any change that materially affects existing applicants or awardees. 

Scholarship Program Privacy Notification

All personal, financial, and academic data submitted through the application is handled in accordance with applicable data protection legislation.

1. Introduction

Agility is committed to protecting your privacy and the privacy of others whose information may be provided as part of the application to the Program. This Privacy Notice explains how Agility collects, uses, shares, retains and protects personal information in connection with the Agility Fellows Scholarship Program. The Agility entity identified in the application form or associated Program documentation is the controller responsible for the personal information processed for the Program. 2. Personal Information We Collect

Depending on the eligibility requirements and information submitted, Agility may process: 

  • Applicant information
    • full name; 
    • date of birth and age; 
    • nationality or passport country; 
    • country of residence; 
    • address and contact details; 
    • relationship to the Agility employee; 
    • university, course and enrolment information; 
    • academic transcripts, grades, GPA and examination results; 
    • personal statements and application responses; 
    • details of extracurricular, community, employment or voluntary activities; 
    • references and supporting statements; 
    • scholarship payment and banking information; and 
    • correspondence relating to the application or scholarship. 
  • Financial and household information
    • parental or household income; 
    • financial-need information; 
    • information about dependents and household circumstances; 
    • evidence supporting financial information; and 
    • details of other grants, scholarships or financial support. 
  • Employee and parent or guardian information
    • employee name, employee identifier, employing entity and work location; 
    • employment status and eligibility information; 
    • parent or guardian identity and contact details; and 
    • authorizations provided on behalf of applicants under 18. 
  • Verification information
    • Agility may receive relevant information from schools, universities, employers, references, community organizations and other persons or organizations identified by the applicant.
    • Applicants should avoid providing information that is not relevant to the application. They should also inform parents, guardians, household members, references and other individuals before submitting their personal information to Agility. 

3. Special-Category or Sensitive Information

An application or supporting document may reveal information such as:

  • health or disability information;
  • racial or ethnic origin;
  • religious or philosophical beliefs;
  • sexual orientation; or
  • other information given enhanced protection under Applicable Law.

Agility will only request or use such information where it is relevant and necessary for the Program and will process in compliance with Applicable Law.  Applicants should not include special-category or otherwise sensitive information unless the application specifically requests it or it is genuinely necessary to explain relevant circumstances. 

4. Purposes of Processing

Agility may use personal information for the purposes of the Program including to: 

  • establish whether an applicant is eligible to participate; 
  • verify the applicant’s relationship to an eligible Agility employee; 
  • assess academic achievement and financial need; 
  • review and score applications against the published criteria; 
  • verify information supplied in an application; 
  • communicate with applicants, employees, parents, guardians and references; 
  • select and notify scholarship recipients; 
  • administer scholarship agreements, payments and continuing eligibility; 
  • prevent and investigate fraud, dishonesty or misuse of Program funds; 
  • respond to questions, complaints, rights requests or disputes; 
  • comply with legal, regulatory, tax, audit and financial obligations; 
  • maintain the security and integrity of the application process; 
  • evaluate and improve the Program; 
  • produce anonymized  or aggregated reports and statistics; and 
  • other activities directly related to the candidate’s assessment for the Program. 

Personal information collected for the Program will not be used for unrelated employment decisions concerning the applicant’s parent or guardian, except where information indicates fraud, serious misconduct, safeguarding concerns or another matter that Agility is legally required or reasonably entitled to investigate.

5. Legal Bases for Processing

Participation in the Program is voluntary. However, once an applicant chooses to apply, Agility must process certain personal information to assess and administer the application.

Depending on the Applicable Law and stage of the Program, Agility may rely on a legal basis under Applicable Law which may include one or more of the following legal bases:

  • processing necessary to take steps at the applicant’s request before entering into a scholarship agreement; 
  • processing necessary to perform or administer a scholarship agreement; 
  • Agility’s legitimate interests in operating a fair, secure and effective scholarship program, verifying eligibility, allocating funding, preventing fraud and administering awards; 
  • compliance with legal, regulatory, financial, tax or audit obligations; 
  • the establishment, exercise or defense of legal claims; and 
  • consent where the processing is genuinely optional and consent is the appropriate legal basis. 

Where legitimate interests are relied upon, Agility will consider the legal rights of the affected individuals as set out in the Applicable Law. 

6. Required Information and Withdrawal from the Program

As noted above, applicants apply to the Program on a voluntary basis and applicants are under no obligation to participate in the Program.

However, where an applicant has applied, certain personal information is necessary to determine eligibility, assess an application and administer a scholarship. If an applicant:

  • does not provide required information; 
  • asks Agility to delete information that remains necessary to assess the application; or 
  • objects to necessary processing and Agility has no overriding lawful reason to continue, 

Agility may be unable to progress with the assessment of the application or continue administering the scholarship where awarded. 

The applicant acknowledges and agrees that the above circumstances shall not be deemed to constitute a withdrawal-of-consent mechanism where Agility is relying on contract, legitimate interests, legal obligation or another lawful basis for the processing of applicant information. 

Where Agility relies on consent for a genuinely optional activity, the individual may withdraw that consent at any time. Withdrawal will not affect processing that took place lawfully before consent was withdrawn.

7. Optional Publicity

Agility will seek separate, specific consent before using an applicant’s or awardee’s: 

  • photograph; 
  • video or audio recording; 
  • testimonial; 
  • personal story; 
  • identifiable interview; or 
  • name and scholarship details 
  • for external publicity, marketing or promotional purposes where consent is required. 

Refusing or withdrawing consent for optional publicity will not affect the assessment of an application, the award of a scholarship or the administration of an existing award. 

8. Sharing Personal Information

Personal information may be shared, where necessary, with: 

  • authorized Agility employees involved in administering or overseeing the Program; 
  • members of the scholarship assessment or selection panel; 
  • relevant Agility group companies; 
  • application-platform, hosting, communications, payment and IT-security providers; 
  • providers of AI or automated assessment tools; 
  • professional advisers, auditors and insurers; 
  • schools, universities, employers, references and organizations contacted for verification; 
  • banks and payment providers; 
  • regulators, courts, law-enforcement authorities or other public bodies where required or permitted by law; 
  • other parties involved in the establishment, exercise or defense of legal claims; and 
  • with other parties who have a legitimate reason for accessing the information which is related to the requirements of the Program. 

  Access will be limited, as far as reasonably practicable, to people who require the information for an authorized  Program purpose. 

 9. International Transfers

Because Agility operates internationally, personal information may be accessed or processed in the UAE, Kuwait and other countries in which Agility group companies, Program personnel or service providers operate. Agility will handle such cross-border transfers of personal information in accordance with Applicable Law.

10. Data Security

Agility will use appropriate technical and organizational measures intended to protect Program personal information against: 

  • unauthorized  or unlawful access; 
  • accidental loss, destruction or damage; 
  • inappropriate alteration or disclosure; and 
  • misuse. 

Measures may include role-based access controls, authentication controls, encryption, logging, confidentiality requirements, security testing and restrictions on downloading or onward sharing. 

No system can be guaranteed to be completely secure. Applicants should therefore use the approved application channel and should not send sensitive supporting documents through unapproved or insecure channels.

11. Data Retention and Deletion

Agility will retain identifiable personal information only for as long as reasonably necessary for the purposes described in this Privacy Notice and to meet applicable legal, audit, financial and dispute-management requirements unless a longer period is required or justified: 

  • Unsuccessful applicants: Personal information relating to unsuccessful applicants will ordinarily be deleted or anonymized  within 12 months after announcement of the final scholarship awards.
  • Awardees: Information relating to awardees may be retained throughout the scholarship and for an appropriate period afterwards where necessary to: 
    • administer and evidence scholarship payments; 
    • verify compliance with scholarship conditions; 
    • satisfy financial, tax, audit or legal requirements; 
    • respond to disputes or legal claims; and 
    • maintain an appropriate record of the award. 

The specific post-award retention period should be determined by the applicable legal, financial and corporate retention requirements. 

  •  Verification records: Information obtained from references, schools, universities and other verification sources will be retained in accordance with the retention period applicable to the relevant application.
  • Anonymized information: Agility may retain non-identifiable, information that has been irreversibly anonymized  so that it no longer identifies any individual. This may include aggregate data (e.g., “Number statistics such as the number of applicants from Spain”) by country or the overall distribution of scholarship awards. 

Information subject to a legal hold, complaint, investigation, audit or dispute may be retained for internal reporting purposes longer where necessary.

12. Individual Rights

Individuals may have rights to: 

  • obtain information about how their personal information is used; 
  • request access to their personal information; 
  • request correction of inaccurate or incomplete information; 
  • request deletion of personal information; 
  • request restriction of processing; 
  • object to processing based on legitimate interests; 
  • receive certain information in a portable format; 
  • withdraw consent where processing is based on consent; 
  • request human intervention or reconsideration in relation to an automated or AI-supported assessment; 
  • raise a complaint with Agility; and 
  • complain to an applicable data protection regulator. 

These rights are not absolute and may be subject to legal conditions, exemptions and the rights of other individuals.  A request to delete, restrict or stop processing information necessary for an active application may mean that Agility can no longer assess the application or administer an award. Agility will inform you of any such consequences.  Requests may be submitted to [email protected].   Agility may request information reasonably necessary to verify the requester’s identity. 

13. Information About Other Individuals

Applicants who provide information about a parent, guardian, child, household member, reference or another person must take reasonable steps to ensure that the person knows: 

  • that their information is being provided to Agility; 
  • why it is being provided; 
  • how Agility may use it; and 
  • how they can obtain further privacy information. 

Applicants should not provide more information about another person than is necessary for the application.

  

Use of Artificial Intelligence

1. How AI Is Used

Due to the potential number of applications, Agility may use an artificial intelligence or automated assessment tool to assist with the initial organisation, screening, analysis and scoring of applications.  The AI tool may: 

  • identify whether required information appears to be missing; 
  • extract information from application documents; 
  • compare application information against the published eligibility or assessment criteria; 
  • create summaries for human reviewers; 
  • suggest preliminary scores or rankings; and 
  • flag applications for further human review. 

Agility will not use the AI tool to make the final scholarship award decision without meaningful human involvement. 

2. Human Decision-Making

Final scholarship decisions will be made by authorized  human decision-makers. Human reviewers will have authority to: 

  • review the underlying application information; 
  • question or disregard an AI-generated output; 
  • correct or adjust a preliminary score; 
  • consider relevant context that the AI tool may not have recognized; and 
  • reach a different decision from the output suggested by the AI tool. 

Human review will be meaningful and not merely an automatic approval of the AI output. 

3. Information Used by the AI Tool

The AI tool may process information submitted in the application and information created during the assessment process.

4. AI Data Retention 

AI-generated scores, summaries, classifications, rankings and flags will be retained only for as long as necessary to complete the selection process, unless pertaining to a candidate for which a scholarship has been awarded, in which case the relevant rules pertaining to the information for successful candidates, as set out in the Scholarship Program Privacy Notice, will apply.

5. Anonymization

We may retain non-identifiable, aggregate data (e.g., “Number of applicants from Spain”) for the relevant application, scholarship administration, audit, complaint, dispute or legal purpose. 

They will be deleted or anonymized in accordance with the retention rules in the Scholarship Program Privacy Notice.
